Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you (the subscribing restaurant, cafe, or food business entity) and Restaurants OS Technologies ("Restaurants OS," "we," "our," or "us"), governing your access to and use of our SaaS platform at https://www.restaurantsos.in/, cloud POS billing software, Kitchen Display Systems (KDS), and related software services.

By subscribing to a paid software tier, paying your subscription fees via our online payment gateway, or using the platform, you agree to be bound by these Terms and our Privacy Policy.

Restaurants OS provides cloud software tools engineered for hospitality operations, enabling subscribing establishments to:

• Deploy digital contactless QR code ordering for fast customer order transmission to the kitchen.
• Operate multi-station Kitchen Display Systems (KDS) with audio bell notifications and preparation timers.
• Run cloud POS billing terminals with thermal receipt printing (ESC/POS 80mm/58mm) and 1-click GST invoice generation.
• Monitor live floor table states (Available, Occupied, Cooking, Bill Requested) and waiter service calls.
• Manage restaurant menus, item modifiers, tax rates, and sales analytics.

Key terms governing software subscription billing and payment processing:

• Starter / Cafe Plan: Priced at ₹2,999 / $39 for 6 Months (effective ₹499 or ~$6.50/month), granting software licensing for up to 10 dining tables, QR self-ordering, cloud POS billing, and standard analytics.
• Pro Restaurant Plan: Priced at ₹6,999 / $89 for 6 Months (effective ₹1,166 or ~$14.80/month), granting software licensing for unlimited dining tables, industrial kitchen KDS with audio chimes, waiter floor console, 80mm thermal receipt printing, GST calculation, deep analytics, and 24/7 priority support.
• Enterprise Plan: Custom software pricing for multi-outlet restaurant chains and global franchise groups.
• Accepted Payment Modes: Software subscription fees are payable online through authorized, PCI-DSS compliant Payment Gateway partners (such as Razorpay) using UPI (PhonePe, Google Pay, Paytm, BHIM), Domestic & International Credit/Debit Cards (Visa, MasterCard, RuPay, American Express), and Net Banking.
• Currency & GST Invoicing: Subscription prices are payable in Indian Rupees (INR) or US Dollars (USD). Invoices for Indian businesses are subject to applicable Goods and Services Tax (GST) and a valid GST tax invoice is automatically issued upon transaction settlement.
• Billing Schedule: Subscriptions are billed in advance on a semi-annual (6 months) or annual (12 months) term.

We maintain transparent transaction policies for all software subscription purchases:

• Immediate Digital Provisioning: New restaurant software instances and license keys are provisioned immediately upon successful subscription payment, accompanied by 1-on-1 digital menu onboarding and staff training.
• Subscription Cancellation: You may cancel your subscription renewal at any time prior to the next billing date by contacting our support desk. Upon cancellation, your software access remains fully operational until the end of the paid term.
• Refund Policy: Because Restaurants OS provides immediate digital provisioning of cloud software resources upon payment, subscription fees are non-refundable once the paid term begins. If documented technical failure on our platform prevents software utilization and our engineering team cannot resolve it within 7 business days from onboarding, a pro-rata refund may be reviewed upon written request.

To avoid any doubt regarding customer transactions:

• Restaurants OS is strictly a B2B SaaS software provider and is NOT an escrow agent or food marketplace.
• All food and beverage preparation, table service, menu pricing accuracy, dietary allergen notices, and direct diner billing remain the sole responsibility of the individual restaurant establishment.
• Restaurants OS takes zero commission on dining bills and does not collect or hold diner payments.

As an administrative account holder, you agree to:

• Provide accurate and complete business, tax (GSTIN), and billing contact information.
• Maintain the confidentiality of administrator login credentials, PIN numbers, and API tokens.
• Promptly notify us of any suspected unauthorized access to your management account.
• Refrain from reverse engineering, copying, or exploiting the platform infrastructure.

All intellectual property rights in the Restaurants OS platform — including source code, UI/UX designs, trademarks, domain names, and algorithmic systems — remain the exclusive property of Restaurants OS Technologies. Subscribing restaurants retain full ownership of their uploaded logos, menu photos, and business data.

We target a 99.9% platform availability SLA for cloud ordering and POS systems. Occasional maintenance updates are scheduled during off-peak hours with advance notice. Restaurants OS includes offline-resilient PWA caching to allow local order view and receipt printing during temporary internet outages.

To the fullest extent permissible under applicable Indian law, Restaurants OS Technologies shall not be liable for any indirect, punitive, special, or consequential damages, including loss of business profits, hardware failures, third-party internet outages, or external banking gateway downtimes outside our reasonable control.

These Terms shall be governed by and construed in accordance with the laws of India. Any legal dispute or proceeding arising out of or in connection with these software subscription terms shall be subject to the exclusive jurisdiction of the competent courts in Rajasthan, India.
